Licence conditions for Dynamicweb

The present licence conditions should be read before the software is installed and put into use. When Dynamicweb is put into use, the licence holder agrees to be subject to the following licence conditions.

 

1. Usage

In the absence of other agreements, the present standard licence conditions are applied to each purchase of Dynamicweb including modules (in the following called “Dynamicweb”) and updates.

 

2. Rights

Ownership of Dynamicweb including programmes and source codes is not included in the purchase of Dynamicweb. The purchase only involves the right to use Dynamicweb with the present standard licence conditions.

 

Dynamicweb including programmes and source codes is protected by copyright and owned by Dynamic Systems A/S. All forms of copying, changing, reverse engineering, decompiling, disassembling, lending and reproducing of Dynamicweb including programmes and source codes are prohibited. And Dynamic Systems A/S will take action to stop it.

 

The purchaser of Dynamicweb is obligated to inform employees and others with access to Dynamicweb of the contents of the present standard licence conditions.

 

3. Handover

A licence to Dynamicweb implies the right to use Dynamicweb to create only 1 web site unless a number of site licences are purchased.

 

Without written consent from Dynamic Systems A/S, the purchaser of a Dynamicweb licence is not entitled to hand over the licence to neither a third party nor internally in the company irrespective of whether the handover should take place as sale, gift, lending or otherwise.

 

4. Liability

As far as Dynamic Systems A/S knows. Dynamicweb does not violate the rights of a third party. However, Dynamic Systems A/S does not in any way guarantee or answer for the correctness that Dynamicweb does not violate the rights of a third party. Nor does Dynamic Systems A/S guarantee that Dynamicweb has a promoting effect or any other commercial value for the purchaser of Dynamicweb.

 

Dynamic Systems A/S can under no circumstances be held responsible for direct or indirect losses, consequential damages or any other form of damages that arise as a consequence of user-, data- or operating loss irrespective of contractual relations, breach of contract or other actionable activities arising in connection to the use of Dynamicweb.

 

5. Law and venue

Agreement of purchase and also the understanding and interpretation of the present standard licence conditions are subject to Danish law. Any disputes, that may occur, are taken to and settled by the Danish Court System with reference to the Administration of Justice Act.
